Spa Rules and Regulations
All spa pools, including portable spas, require a building consent.
Spa pools that are not in a building or enclosed structure are new required to fully comply with the Fencing or Swimming Pools Act 1987, i.e. all spa pools must have a complying fence. This also applies to portable spa pools.
In October 2002, the building Industry Authority (BIA) determined that lockable spa pool covers are no longer suitable safety barriers. Auckland City no longer accept a lockable spa cover as a means of complying with the Building Code and Fencing of Swimming Pools Act. This applies to consents for all new spa pools. It applies to consents for all new spa pools. It will also apply to consents to existing spa pools where the pool has never previous been consented.
All spa pools which had been inspected and approved prior to November 2002 will continue to comply. This means that if your spa pool has a lockable spa pool cover that was consented prior to 11 November 2002 it will continue to comply.
Spa Pools already installed without a consent
Q: What if I have installed a spa pool without a building consent?
A: If the spa is not fenced it should be emptied immediately. You will then need to apply for a Certificate of Acceptance.
As well as being illegal, a non-compliant spa pool can affect your home insurance and become a problem if you want to sell your property. To learn more, go to the
